1. Agreement to these Terms
These Terms of Service (“Terms”) govern your access to and use of PokerNight (“we,” “us,” or “our”). By creating an account or using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use PokerNight.
2. What PokerNight is—and is not
PokerNight is a software utility for organizing and recording private poker sessions. It can help users manage players, record buy-ins, rebuys, cash-outs, chip counts and corrections, calculate results and settlement instructions, and preserve history and statistics.
PokerNight does not operate poker games; deal cards; accept or place bets; act as a casino, bookmaker, or gambling operator; or provide an online real-money poker game.
PokerNight does not hold, transfer, settle, process, or facilitate player funds. User-entered amounts, payment-method labels, payment statuses, and settlement instructions are records and calculations only. Players perform any actual payments or transfers independently, outside the service.
3. Accounts and eligibility
You must provide accurate account information, keep your sign-in credentials secure, and promptly notify us if you suspect unauthorized access. You are responsible for activity under your account.
You may use PokerNight only if you are legally capable of agreeing to these Terms. The service is not directed to children under 13. Poker or gaming activity may be restricted to a higher minimum age in your location, and PokerNight does not verify your age or legal eligibility to participate.
Third-party sign-in options, including Apple or Google, are also governed by the applicable provider’s terms.
4. Your responsibilities and acceptable use
You are solely responsible for:
- complying with gambling, gaming, tax, financial, privacy, and other laws that apply to you and your private game;
- determining whether a private poker game is lawful in your jurisdiction;
- the accuracy of players, amounts, chip counts, payment statuses, and other data entered into PokerNight;
- reviewing results before finalizing a session;
- settlements and transfers performed outside PokerNight; and
- having a lawful basis and any necessary permission to enter another person’s name or contact information.
You may not misuse the service, attempt unauthorized access, interfere with its operation, bypass access controls, upload malicious code, harass others, impersonate another person, scrape user data, or use PokerNight to organize unlawful activity.
5. User-generated data
You retain your rights in information you submit. You grant us a limited license to host, process, reproduce, and display that information only as needed to provide, maintain, protect, and improve the service and comply with law.
Game hosts control their own rosters and owned game records. Registered participants may receive access to records associated with their linked player identity. You are responsible for ensuring that the data you enter is accurate, lawful, and does not infringe another person’s rights.
Finalized financial ledger records may be treated as immutable within normal app use to preserve consistency. Account deletion and owner-history reset processes can remove data through privileged service operations as described in the Privacy Policy.
6. Service availability and changes
We may change, suspend, or discontinue all or part of PokerNight. We do not promise uninterrupted, error-free, or permanent availability. Internet access and compatible device software may be required. You should review important session information before relying on it and keep any separate records you consider necessary.
7. Our software and content
PokerNight, including its software, design, branding, and non-user content, is owned by us or our licensors and protected by applicable law. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the service for its intended purpose. They do not transfer ownership of PokerNight to you.
8. Disclaimers
To the maximum extent permitted by law, PokerNight is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
Calculations depend on the data users enter and the session state they confirm. We do not warrant that a result, statistic, payment status, or settlement instruction is legally, financially, or mathematically appropriate for your circumstances. PokerNight does not provide legal, tax, gambling, or financial advice.
9. Limitation of liability
To the extent permitted by applicable law, PokerNight is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunity arising from PokerNight or a private game. Mandatory consumer rights are not limited by these Terms.
10. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless PokerNight from claims, losses, and expenses arising from your unlawful use of PokerNight, your private game, data you submit, or your violation of these Terms or another person’s rights.
11. Termination and account deletion
You may stop using PokerNight at any time and delete your account in the app through Settings → Account → Delete account, as described on the Support page. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, or misuse the service.
Sections that by their nature should survive termination—including ownership, disclaimers, liability, indemnity, dispute terms, and provisions concerning records owned by other users—will survive.
12. Changes to these Terms
We may update these Terms by posting a revised version here. If a change is material, we may provide additional notice. Continuing to use PokerNight after updated Terms take effect means you accept them, where permitted by law.
13. Governing law and disputes
These Terms do not limit any mandatory consumer protections that apply where you live. Any dispute will be handled in accordance with applicable law.
14. General
These Terms and the Privacy Policy are the entire agreement between you and us about PokerNight. If one provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, financing, reorganization, or sale of assets.
